This Privacy Policy explains how PS ARMY, LLC collects, uses, and discloses information about you. This Privacy Policy applies to information we collect when you use our website, and other online products and services that link to this Privacy Policy (collectively, our "Services"), contact our customer service team, engage with us on social media, or when you otherwise interact with us.


We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of the policy and, in some cases, we may provide you with additional notice (such as adding a statement to our homepage or sending you a notification). We encourage you to review this Privacy Policy regularly to stay informed about our information practices and the choices available to you.

Collection of Information.

 

Information You Provide to Us.

We collect information you provide directly to us. For example, you share information directly with us when you create an account, submit or post product reviews via our Services, make a purchase or donation, communicate with us via third-party platforms, participate in an event, request customer support, or otherwise communicate with us. The types of personal information we may collect include your name, email address, birth month and day, postal address, phone number, credit card and other payment information, photos, product review information including any information you choose to provide. In some cases, we may also collect information you provide about others, such as if you purchase a gift card for someone or decide to purchase and ship products to someone.

Information We Collect When You Use the Services

When you access or use our Services, we automatically collect information about you, including:

  • Log Information: We collect log information about your use of the Services, including the type of browser you use, access times, pages viewed, your IP address.

  • Transactional Information: When you make a purchase or return, we collect information about the transaction, such as product details, purchase price, any charitable donation you make in connection with your purchase, and the date and location of the transaction.

  • Device and Usage Information: We collect information about the computer or mobile device you use to access our Services, including the hardware model, operating system and version, unique device identifiers and mobile network information.

We obtain information from third-party sources. For example, we may collect information about you from social networks, identity verification services, advertising networks, and data analytics providers.

Information We Derive

We may derive information or draw inferences about you based on the information we collect. For example, we may infer that you are looking to purchase certain products based on your browsing behavior and past purchases or we may infer your location based on your IP address.

 

Use of Information.

We use the information we collect to provide the products you request. We also use information we collect to:

  • Provide, maintain and improve our products and Services;

  • Process transactions and returns and send you related information, including confirmations, receipts, invoices, customer experience surveys, and recall notices;

  • Personalize and improve your experience on our Services;

  • Send you technical notices, security alerts and support and administrative messages;

  • Respond to your comments and questions and provide customer service;

  • Communicate with you, including via email and text message, about services, products, events and promotions offered by PS ARMY and others, and provide information we think will be of interest to you.

  • Personalize the advertisements you see on third-party platforms and websites (for more information, see the Advertising and Analytics section below);

  • Facilitate contests, sweepstakes, and promotions and process and deliver entries and rewards;

  • Monitor and analyze trends, usage and activities in connection with our Services, events and other offerings;

  • Debug to identify and repair errors in our Services;

  • Carry out any other purpose described to you at the time the information was collected

Data Storage

PS ARMY is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.

All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

As Wix is our website builder platform; it's responsible for storing the PS ARMY's visitors' data in a number of locations.
The site-visitors ́ personal information may be stored in data centers located in the United States of America, Ireland, South Korea, Taiwan and Israel. We may use other jurisdictions as necessary for the proper delivery of our services and/or as may be required by law.

Wix is a global company that respects the laws of the jurisdictions it operates within. The processing of the User Customer Data may take place within the territory of the European Union, Israel or a third country, territory, or one or more specified sectors within that third country, of which, the European Commission has decided that it ensures an adequate level of protection (transfer on the basis of an adequacy decision).

Sharing of Information.

We may share information about you as follows or as otherwise described in this Privacy Policy:

  • We share personal information with vendors, service providers, and consultants that need access to such information to perform services for us, such as companies that assist us with web hosting, shipping and delivery, payment processing,  fraud prevention, customer service, marketing, and advertising.

  • We may share certain information publicly on our Services or through our social channels, such as if you submit a product review.

  • We may disclose personal information if we believe disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements. 

  • We may share personal information if we believe your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to or to protect the rights, property and safety of PS ARMY or others.

  • We may share personal information with our lawyers and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.

  • We may share personal information between and among PS ARMY and our current and future parents, affiliates, and subsidiaries and other companies under common control and ownership

  • We share personal information with your consent or at your direction.

Advertising and Analytics Services Provided By Others.

We may allow others to provide analytics services and serve advertisements on our behalf across the Internet and in applications. These entities may use cookies, web beacons, device identifiers and other technologies to collect information about your use of the Services, including your IP address, web browser, mobile network information, pages viewed, time spent on pages, links clicked and conversion information. This information may be used by PS ARMY and others to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on our Services and other websites, and better understand your online activity. For more information about interest-based ads, or to opt out of having your web browsing information used for behavioral advertising purposes. 

We may also work with third parties to serve ads to you as part of customized campaigns on third-party platforms (such as Facebook and Instagram). As part of these ad campaigns, we or the third-party platforms may convert information about you, such as your email address and phone number, into a unique value that can be matched with a user account on these platforms to allow us to learn about your interests and serve you advertising that is customized to your interests. Note that the third-party platforms may offer you choices about whether you see these types of customized ads.

  • Cookies

Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject browser cookies. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of certain of our Services.

  • Communications Preferences

You may opt out of receiving text messages or promotional emails from PS ARMY by following the instructions in those communications. If you opt out, we may still send you non-promotional emails, such as those about any ongoing business relations we may have.

 ADDITIONAL DISCLOSURES FOR CALIFORNIA RESIDENTS

 

If you are a resident of the state of California, this section addresses your rights under the California Consumer Privacy Act of 2018 (“CCPA”). Any terms defined in the CCPA have the same meaning when used in this Policy.

Use of Personal Information
We may use or disclose the personal information we collect for one or more of the business purposes indicated in this Policy.

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

Sharing Personal Information
We may disclose your personal information to a third party for a business purpose. When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract. We do not sell personal information. In the event that we do sell any personal information, we will update this Policy to list the categories of consumers’ personal information sold.

Your Rights and Choices
The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

A. Right to Access Specific Information and Data Portability Right 

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past twelve (12) months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of personal information we collected about you.

  • The categories of sources for the personal information we collected about you.

  • Our business or commercial purpose for collecting or selling that personal information.

  • The categories of third parties with whom we share that personal information.

  • The specific pieces of personal information we collected about you (also called a data portability request).

  • If we disclosed your personal information for a business purpose, the business purpose for which personal information was disclosed, and the personal information categories that each category of recipient obtained.

B. Right to Delete

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.
 

C. Exercising Your Rights
To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:​

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make such a request for access or data portability twice within a 12-month period. The verifiable consumer request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, and describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We will deliver our written response electronically. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination
We will not discriminate against you for exercising any of your CCPA rights.

California Shine the Light Law
California Civil Code Section 1798.83 permits users who are California residents to obtain from us once a year, free of charge, a list of third parties to whom we have disclosed personal information (if any) for direct marketing purposes in the preceding calendar year.
